Terms of Service

These Terms of Service ("Terms") govern your use of GoClarion, operated by GoClarion ("we", "us", "our"), accessible at goclarion.app. By creating an account or using GoClarion, you agree to these Terms.

1. What GoClarion Does

GoClarion is an AI-assisted sales outreach platform. It helps you research prospect companies, identify contacts, and generate personalised email drafts using AI. Drafts wait in GoClarion for your review, and are sent from your own mailbox. The first email to each contact is always approved by you; later steps of a sequence send automatically only if you turn that on.

2. Eligibility

You must be at least 18 years old to use GoClarion. By using the service, you confirm that you meet this requirement and have the authority to agree to these Terms on behalf of yourself or your organisation.

3. Your Account

You are responsible for maintaining the security of your account credentials. You must notify us immediately at hello@goclarion.app if you suspect unauthorised access. We are not liable for any loss resulting from unauthorised use of your account.

4. Your AI API Keys

GoClarion uses AI API keys that you provide (e.g. OpenAI, Anthropic, Google Gemini) to perform research and generate email drafts. You are responsible for:

• Ensuring your API keys are valid and have sufficient credits
• Any costs incurred with your AI provider from GoClarion's use of your keys
• Complying with your AI provider's terms of service

We store your API keys encrypted and use them solely to make AI calls on your behalf. We do not use your keys for any other purpose.

5. Mailbox Access

GoClarion does not use the Gmail API and does not request any Gmail permission from your Google Account. You connect a mailbox — including Gmail or Google Workspace — with an app password over SMTP and IMAP, or Outlook / Microsoft 365 with Microsoft sign-in. GoClarion then sends the emails you approve, can place drafts in your Drafts folder, and checks for replies to emails it sent. You can revoke this access at any time from your workspace settings, by deleting the app password in your email provider's security settings, or from your Microsoft account.

You must follow your email provider's own terms and sending policies (for Gmail and Google Workspace, Google's Gmail Program Policies and sender guidelines), including their limits on volume. GoClarion does not provide email warming, warm-up networks, or any feature designed to raise or get around a mailbox's sending limits or spam filters.

You remain solely responsible for the emails you send. GoClarion generates drafts as suggestions — you review and approve them before they are sent (or turn on automatic sending for later steps of a sequence you created). We are not responsible for the content of emails you choose to send.

6. Free Trial and Plans

New workspaces start with a 14-day free trial; no payment card is required. When the trial ends, the workspace becomes read-only: your accounts, contacts, emails and settings are kept, and replies continue to be recorded, but research, drafting and sending pause until the workspace is on a plan. To continue, email hello@goclarion.app. Plan features, limits (including the number of workspaces you can own) and prices may change; we will tell you before a change affects a plan you are on.

7. Teams and Workspaces

A workspace can have several members. The workspace owner is responsible for who is invited, for the roles they are given, and for all activity in the workspace. Everyone in a workspace can see its accounts, contacts, drafts and replies. Only invite people you are authorised to share that information with. Owners and admins can remove members at any time.

8. Acceptable Use

You agree not to use GoClarion to:

• Send spam or unsolicited bulk emails
• Violate applicable anti-spam laws (CAN-SPAM, CASL, GDPR, or similar)
• Harass, threaten, or deceive recipients
• Scrape, copy, or resell any part of the GoClarion service
• Attempt to gain unauthorised access to GoClarion's systems
• Use the service in any way that violates applicable laws or regulations

We reserve the right to suspend or terminate accounts that violate these rules without notice.

9. Email Compliance

You are solely responsible for ensuring your outreach complies with all applicable email laws in your jurisdiction and the recipient's jurisdiction, including but not limited to CAN-SPAM (USA), CASL (Canada), and GDPR (EU/UK). GoClarion provides tools to assist compliance (unsubscribe links, one-click unsubscribe, suppression lists, fixed daily sending limits) but cannot guarantee compliance on your behalf.

10. Intellectual Property

GoClarion and its original content, features, and functionality are owned by GoClarion and are protected by applicable intellectual property laws.

You retain ownership of all content you provide to GoClarion (workspace config, company data, email drafts). By using GoClarion, you grant us a limited licence to process this content solely to provide the service.

11. Disclaimer of Warranties

GoClarion is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that AI-generated content will be accurate or suitable for your purposes.

AI-generated research and email drafts are suggestions only. You are responsible for reviewing and verifying all content before use.

12. Limitation of Liability

To the fullest extent permitted by law, GoClarion shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of GoClarion, including but not limited to loss of revenue, loss of data, or damage to reputation resulting from emails sent using GoClarion.

Our total liability to you for any claim arising from your use of GoClarion shall not exceed the amount you paid us in the three months preceding the claim.

13. Termination

You may delete your account at any time by emailing hello@goclarion.app from the address on your account. We may suspend or terminate your account for violations of these Terms, with or without notice.

Upon termination, your right to use GoClarion ceases immediately. We will delete your data in accordance with our Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the app. Continued use after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of GoClarion shall be subject to the exclusive jurisdiction of the courts of India.
